1. Acceptance

By accessing or using HybridBeastBrain™ ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all users, including coaches, gym managers, and administrators.

2. Description of service

HybridBeastBrain™ provides algorithmic training plan management software for hybrid fitness gyms. The Service includes a coach portal, athlete management tools, plan generation, and email delivery features. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice.

3. Accounts and subscriptions

You must provide accurate information when creating an account. You are responsible for maintaining the security of your credentials. Subscriptions are billed monthly and renew automatically unless cancelled. The 15-day free trial is available once per account. After the trial, a paid subscription is required to continue using the Service.

4. Acceptable use

You agree not to: use the Service for any unlawful purpose; attempt to reverse-engineer, copy, or reproduce the engine or any proprietary algorithms; share account credentials with parties outside your organisation; use automated scripts to access the Service in ways that exceed normal usage; upload content that is illegal, harmful, or infringes third-party rights.

5. Athlete data

You are responsible for obtaining any necessary consents from your athletes before entering their personal data into the platform. You retain ownership of all athlete data you upload. By using the Service, you grant us a limited licence to process that data solely to provide the Service to you.

6. Intellectual property

The HybridBeastBrain™ name, logo, algorithmic engine, and all platform content are the exclusive intellectual property of Pablo Lozano Lominchar, operating under the trade name HybridBeastBrain™. Training plans generated by the platform are provided for your use within the scope of your subscription. You may not resell or sublicence generated content to third-party platforms.

7. Medical disclaimer

The training plans generated by HybridBeastBrain™ are for informational and coaching purposes only. They do not constitute medical advice. Coaches and athletes are responsible for assessing individual fitness levels and health conditions before implementing any training programme. Consult a qualified healthcare professional before starting any new exercise regimen.

8. Limitation of liability

To the maximum extent permitted by law, the Operator shall not be liable for any indirect, incidental, or consequential damages arising from use of the Service, including but not limited to athletic injury, loss of data, or lost revenue. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Cancellation and refunds

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. We do not offer prorated refunds for unused time within a billing period. If you believe you have been charged in error, contact us within 30 days at info@hybridbeastbrain.com.

10. Governing law

These Terms are governed by the laws of Spain. Any disputes shall be subject to the exclusive jurisdiction of the courts of Madrid, Spain.
